BDAFor the purpose of organizing the Governing Board, the Board shall meet at the most convenient public facility in the District. (If a public facility is not available within the District, the Board may meet at any available public facility convenient to all Board members, regardless of the county or school district in which the facility is located.) Such meeting shall be held annually in January.
The meeting shall be called to order by the President of the Board for the preceding year. If that person is not a member of the Board, or is not present, the Vice President of the Board for the preceding year, if any, shall call the meeting to order. If that person is also not a member of the Board or is not present, a temporary chairperson shall be appointed by the Superintendent and the meeting shall be called to order by the temporary chairperson. The temporary chairperson calling the meeting to order shall preside until a President is elected to the Board.
The new President of the Board shall take office upon election.
Board Officer Vacancy
Whenever there is a vacancy in the office of President as defined by Arizona law, the Vice President shall fill the vacancy during the unexpired term of office.
Whenever there is a vacancy in the office of the Vice President as defined by Arizona law, the Board may, should it choose to do so, elect a new officer to serve as Vice President during the unexpired term of office.
If there is a vacancy in both the office of President and Vice President as defined by Arizona law, the Board shall elect new officers to serve during the unexpired term of office.
Appointment of New Officer
The Board may appoint a new officer to serve during the remainder of the current officer’s term if the current officer has ceased to discharge the officer's stated duties as established by Board policy or as assigned to the officer by the Board. A Motion to appoint a new officer is only proper after counsel has undertaken an independent, confidential investigation into the allegations against the current officer and issued an opinion to the Board stating that there is evidence supporting the allegations and the matter cannot be resolved satisfactorily in any other way. The Board may vote to place the officer on leave from the officer's duties pending the outcome of the investigation. If after investigation counsel’s opinion is favorable to the officer, or if it finds that the matter can be resolved satisfactorily without removal, counsel reports that fact to the Board. The officer shall then be automatically reinstated for the duration of the officer's term. The Board may also vote to place an officer on leave from the officer's duties pending the outcome of any criminal investigation into whether the officer has committed a felony or offense involving a violation of official duties. If the criminal investigation results in felony or other charges for offenses involving a violation of official duties being brought against the officer, the Board may then vote to appoint a new officer to serve during the remainder of the current officer's term.
